Terms of Service

Hit your step goal and you pay nothing. Miss a day we can verify, and we charge the stake you chose. There is no prize and no pot - the only money that ever moves is yours, and it only moves when you miss.

1. Who we are

Strutty is run by Pino Kokol s.p. In this document we means that business and you means the person who holds the account. Write to us at support@strutty.app.

By creating an account you agree to these terms. If you do not agree with them, do not use Strutty.

2. What Strutty is

Strutty is a commitment device. You set a daily step goal and choose what a missed day costs. Apple Health supplies the step count. Hit the goal and nothing happens. Miss it, under the rules below, and we charge the stake you picked.

You cannot win money on Strutty. There is no pot, no pool, no prize, no jackpot and no other player. Money moves in one direction only: out of your account, to us, when you miss a day you promised to walk. You are not betting against anyone and there is nothing to win. Strutty is not gambling and is not a game of chance.

The app is free. There is no subscription. Stakes are not sold through Apple. They are charged to the payment method you save with Stripe, our payment processor.

3. Who can use Strutty

You may use Strutty if:

One account per person. Keep your details accurate and your sign-in to yourself. You are responsible for what happens under your account.

4. Your commitment

A commitment has three parts: a daily step target, a stake, and the days it applies to.

We keep a dated copy of your settings. A day is always judged by the target and stake that applied on that date. Raising or lowering your stake later never changes what an earlier day costs.

If we change the wording of the permission you gave, we ask you to agree again before we charge under it. A charge with missing or mismatched permission is refused, not guessed at.

5. How a day is judged

Days run on your phone’s timezone.

  1. Shortly after midnight, at 00:15 your local time, we look at the day that just ended.
  2. Steps at or above target: the day passes and nothing happens.
  3. Steps below target: the day becomes a provisional miss. That is not a charge.
  4. You then have until 10:00 the next morning. If late steps sync and reach the target before any money moves, the day flips to passed and you pay nothing.

With notifications on, you get a heads-up at 18:00 if you are behind, a final warning at 21:00, and a notice the next morning while grace is running. We send these on a best-effort basis. A phone that is off, silent or offline may not show them, and a reminder you never saw does not cancel a charge. The rules above do not depend on the reminder.

Step sync accepts today and yesterday only, so a day cannot be repaired weeks later. Each day is capped at 150,000 steps.

6. When we charge

We charge your stake only when every one of these is true:

The amount is exactly the stake recorded on that day. We never charge a day twice, and we never invent a day you missed while the service was down.

Pausing. Pausing stops days we have not yet judged. It does not rescue a day that had already become a provisional miss when you paused. Cancelling works the same way.

7. When Apple Health did not sync

We cannot tell someone who did not walk from someone whose phone did not sync, so we never charge an unverified day.

8. Extra card checks

Sometimes your bank asks you to confirm a payment. We record that, tell you to open the app, and you finish the check there. The day settles once your bank confirms.

9. When a payment fails

We try again about six hours later, and once more about a day after that. After 3 failed attempts we stop, pause your goal and tell you. We do not stack up hidden debts, we do not chase you for the money and we do not pass it to a debt collector. That stake goes unpaid and we write it off.

10. Appeals and refunds

Every charge can be appealed within 48 hours of that day’s 10:00 grace deadline. One appeal per day.

Appeals are our own promise, on top of your legal rights. They do not replace anything the law gives you.

Raising a dispute with your bank is a different thing. It pauses your goal, and we handle it by hand. Please talk to us first - an appeal is faster.

11. Your right to withdraw

Strutty is a digital service you buy at a distance, so EU consumer law normally gives you 14 days to withdraw. Two things follow from the way Strutty works.

The app itself is free, so until a stake is charged there is nothing to withdraw from. When you commit to a goal, you ask us to start performing straight away, and you agree that each charge for a missed day is performed in full at the moment we make it. You accept that you lose the 14-day right of withdrawal for that charge once it is made.

This does not touch the 48-hour appeal, any refund we approve, or any consumer right that cannot be signed away.

12. Changing, pausing and cancelling

Change your target, stake or rest days whenever you like. Changes apply from the date they take effect forward. They never rewrite a day that has already been judged. You can pause or cancel a goal at any time in the app.

13. Deleting your account

You can delete your account in Settings. We ask you to type DELETE to confirm, because it cannot be undone.

Deletion waits while money is in flight: a charge in progress, an open appeal, an open dispute, or a missed day that could still be charged. Finish those first, or wait for them to settle, then delete.

Deleting removes our records of you: account, sign-in, sessions, profile, goals, settings history, permissions, goal days, step reports, charges and resolved appeals. We remove them rather than anonymise them.

Stripe keeps its own record of payments it processed. It has to, as a regulated payment company and as evidence if a dispute arrives later. We cannot delete those records for you. Backups roll off within 30 days.

A goal paused after 3 failed payments does not block deletion. We write the unpaid stake off rather than hold your account hostage.

14. Using Strutty honestly

Do not:

We keep every step report we receive. If you cheat, we may close your account and refuse you service.

15. What Strutty is not

Strutty is not a health or medical service and gives no medical advice. You choose your own target. If you are unsure whether a daily step goal is safe for you, ask a doctor first. Do not use Strutty if walking to a target could harm you.

We provide the app as it is. We do not promise it will never be down, never miss a notification, or never lose a sync. What we do promise is that no charge happens outside the rules in sections 5 and 6, and that every charge can be appealed. For everything else, our total liability to you is capped at the stakes you paid us in the twelve months before the claim. Nothing here limits our liability for death, personal injury, fraud, or anything else the law does not allow us to limit.

16. Changes to these terms

We post changes here with a new date at the top. If a change matters to you, we tell you in the app or by email before it takes effect. A change to how or when we charge always requires your fresh agreement before any charge is made under it.

17. Ending this agreement

You can cancel or delete at any time. We may suspend or close an account for a serious breach of these terms, for fraud, or where the law requires it. If we close your account, we do not charge for days after it closed.

18. Law and disputes

These terms are governed by the law of Slovenia, and the courts there hear disputes about them. If you are a consumer living elsewhere in the EU, you keep the protection of the mandatory law of your own country and can bring a claim where you live.
